Last Updated: 9 June 2025 · Effective Date: 9 June 2025

1. Definitions

In these Terms & Conditions, the following terms have the meanings set out below:

2. Acceptance of Terms

By contacting Restu Bela, submitting an enquiry, engaging our services, or using our website, you confirm that you have read, understood, and agree to be bound by these Terms. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person, you confirm that you have authority to do so.

3. Description of Services

Restu Bela provides family law legal services in Malaysia, including:

Services are provided primarily to clients based in Kuala Lumpur and the Klang Valley region. Remote consultations may be available at our discretion. The specific scope of each engagement is confirmed in a written fee agreement before work commences.

4. Engagement and Fee Agreement

No solicitor-client relationship is formed until both parties have agreed the scope and fee in writing. Fees are fixed and payable as outlined in the written fee agreement. Currency is Malaysian Ringgit (RM). Payment is due as specified in the fee agreement; work may be paused if payment is overdue.

Restu Bela does not operate on a contingency fee basis. Our fees are for professional time and expertise and are not conditional on any particular outcome.

5. Client Responsibilities

As a client, you agree to:

6. Confidentiality

We maintain strict confidentiality over all information you share with us in the course of your legal matter. This obligation is protected by legal professional privilege and continues after the conclusion of our engagement. Please refer to our Privacy Policy for full details.

7. Intellectual Property

All content on the Restu Bela website — including text, layout, design, and images — is the property of Restu Bela and may not be reproduced, distributed, or used without written permission. Documents prepared by Restu Bela specifically for your matter may be used by you for the purpose for which they were prepared.

8. Disclaimers

Legal advice provided by Restu Bela is based on the information you supply and the law as it stands at the time of advice. We cannot account for changes in law, court decisions, or circumstances that arise after advice is given. Nothing in our communications constitutes a commitment to any particular outcome.

Our website is provided for general informational purposes only. Content on the website does not constitute legal advice and should not be relied upon as such.

9. Limitation of Liability

To the maximum extent permitted under Malaysian law, Restu Bela's liability to you in connection with any matter shall not exceed the total fees paid by you for the specific service giving rise to the claim. We are not liable for indirect, consequential, or special losses, including lost income, loss of relationships, or emotional distress, except where required by law.

Nothing in these Terms limits our liability for fraud, gross negligence, or other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Restu Bela, its solicitors, and staff from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your provision of inaccurate or misleading information, or your unlawful conduct.

11. Termination

Either party may terminate an engagement by providing reasonable written notice. You may terminate at any time; fees for work already completed are payable. Restu Bela may terminate the engagement if you fail to provide necessary instructions, payment becomes significantly overdue, a conflict of interest arises, or continued engagement would breach professional conduct rules.

On termination, we will provide your file and documents in an orderly manner, subject to any outstanding fees being settled.

12. Dispute Resolution

These Terms are governed by the laws of Malaysia. In the event of a dispute, we encourage direct communication as a first step. If the matter cannot be resolved informally, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia seated in Kuala Lumpur.

Clients also have the right to raise concerns with the Malaysian Bar's complaints body where relevant professional conduct issues arise.

13. General Provisions

14. Changes to These Terms

We may revise these Terms from time to time. Updated Terms will be published on this page with a revised "Last Updated" date. Your continued use of our services after any changes indicates acceptance of the revised Terms.
